Govt issues notifications for extending CrPC, CPC to all courts in Meghalaya
The state government on Tuesday issued notifications for extending CrPC and CPC to all courts in the state.
The notifications issued by the Secretary in-charge Law department said the Governor is pleased to apply the provisions of the Code of Civil Procedure 1908 and provisions of the Code of Criminal Procedure, 1973 to the courts in the state of Meghalaya.
They however said the District Council Courts shall continue to derive powers under paragraphs 4 and 5 of the Sixth Schedule to the Constitution of India.
The notifications said the Governor further directs that, notwithstanding such application, all actions taken by the Courts throughout Meghalaya, under the Rules for the Administration of Justice and Police in the Khasi and Jaintia Hills, 1937 and the Rules of Administration of Justice and Police in Garo Hills, 1937 shall be deemed to have been taken under the relevant provisions of the Code of Civil Procedure, 1908 and relevant provisions of the Code of Criminal Procedure, 1973.
Earlier, the autonomous district councils (ADCs) have opposed the decision and demanded to exempt the district council courts from the notifications.
