HC dismisses writ petition by HPC over Sweeper’s Colony issue
SHILLONG: The Meghalaya High Court on Thursday dismissed a writ petition seeking direction to the state government to restrain from taking any action against residents of Them Iew Mawlong.
The order was passed by the division bench comprising of Chief Justice Ajay Kumar Mittal and Justice HS Thangkhiew while hearing the writ petition filed by the Harijan Panchayat Committee (HPC) headman Billu Singh.
The writ petition was filed under Artilce 226 of the Constitution of India for a direction to the respondents restraining them from taking any action against the Harijan Colony Barra Bazar.
During the hearing, the counsel for the petitioners submitted that inadvertently certain errors have crept in the writ petition.
Accordingly, a prayer was made that he may be allowed to withdraw the instant writ petition with liberty to the petitioners to file a fresh writ petition on the same cause of action by furnishing better particulars. The bench accordingly dismissed the writ petition as withdrawn with liberty prayed for.
At the same time, the Court also disposed of an application in view of the order being passed.
“In view of the order passed of even date in WP(C) No. 161 of 2019, nothing further survives for consideration in the instant application, accordingly, is disposed of,” the order said.
Meanwhile, senior advocate VGK Kynta informed that the writ petition by Singh also sought quashing the agreement executed between the Syiem of Hima Mylliem and the Shillong Municipal Board relating to a plot of land for housing the workers of the SMB and the matter was disposed of.
He said the writ petitioner wanted to amend the writ petition consequent to the affidavit in opposition filed by him on behalf of KHADC challenging infirmities in the writ petition.
